MOLD: An informational pamphlet regarding common mold related hazards that can affect real property is available at the EPA website https://www.epa.gov/iaq/molds/index.html. By initialing this section, Resident acknowledges that Management has provided Resident with the EPA website enabling Resident to obtain information regarding common mold related hazards.
It is generally understood that mold spores are present essentially everywhere and that mold can grow in most any moist location. Resident acknowledges the necessity of housekeeping, ventilation, and moisture control (especially in kitchens, bathrooms, break rooms and around outside walls) for mold prevention.
In signing this Lease, Resident has first inspected the Premises and certifies that it has not observed mold within the Premises.
Resident recognizes that Management will not be responsible for the cleanup of any mold that occurs due to Resident’s actions or negligence and further acknowledges that, should a mold infection be deemed to be caused by Resident’s actions or negligence, Management may require mold removal on the premises be conducted at Resident’s expense.
Resident agrees to immediately notify Management if it observes mold/mildew and/or moisture conditions (from any source, including leaks), and Resident will evaluate and make recommendations and/or take appropriate corrective action.
In consideration of the foregoing, Resident and Management agree that should Resident find evidence of mold inside the house, suspect the product of mold inside of the house/and or believe or suspect that any persons may be experiencing adverse health conditions due to the presence of mold inside of the house during their occupancy they may so notify Management in writing providing the specific details as to their concern. Upon receipt of such written notice Management shall arrange to have the house inspected by an independent mold inspector (not associated with remediation activity) for active mold, take air samples from inside and outside of the house and have such samples tested by a Laboratory. Should such inspection and Laboratory Report indicate the presence of elevated indoor mold spores or colonies that may be hazardous to the health of a normal person Management shall take appropriate remediation action for the mold condition within a reasonable time thereafter. In such specific event, Resident will have the option to terminate the Lease early without penalty provided that written notice to do so is received by Management within 15 days following receipt of the Laboratory Report and that Resident provides 30 days advance written notice of their departure date and that provided all rent is paid through the departure date. All other conditions of the Lease will continue to apply. However, should such Inspection and Laboratory Report indicate that elevated mold spore or colonies that may be hazardous to health of a normal person are not present inside of the house then Resident will be responsible to reimburse Management for the cost of such Inspection Laboratory Report Said reimbursement to Resident to be made within 30 days after receipt by Resident of a copy of the invoice for the Inspection and Laboratory Report.
Resident specifically agrees and confirms that the provisions in the previous paragraph of this Article constitute the total extent of Resident’s responsibility and of Resident’s rights with regard to mold. Resident unconditionally and without limitation hereby indemnifies and protects Management from and against all claims, costs, lability, medical treatment, negligence, etc. with respect to mold, both. during and after occupancy under the Lease, including, but not limited to, moving or relocation costs, damage to Resident property, injury, adverse impact on health, sickness, death, medical expenses, etc. to Resident and/or any persons living in or visiting the premises during the term of the Lease.

3. RENT: The Annual Rental Rate is TWENTY THOUSAND ONE HUNDRED AND 00/100 DOLLARS (****$20,100.00 ) Rent is payable monthly installments in advance without notice or demand at the rate of ONE THOUSAND SIX HUNDRED SEVENTY-FIVE AND 00/100 DOLLARS (****$1,675.00 ) each , due on the 1 st day of each and every month during the initial or any extended term of this Agreement, and shall be annually adjusted. Rental payment shall be made on the specified tenant portal, Innago, unless agreed by both parties. MAILING THE MONTHLY INSTALLMENT PAYMENT BY THE DUE DATE DOES NOT CONSTITUTE PAYMENT. Resident herewith agrees any monies received by Management will be applied first to any lost rental discount; second to any outstanding additional rent; third to any unpaid fees or charges, then fourth to any current monthly rent installment payment or monthly rent installment payment to become due. This may result in unpaid rent, which is subject to additional rent charges as contained herein . Cash will not be accepted.
4. DISCOUNT FOR PROMPT PAYMENT AND MAINTENANCE: Time is of the essence of this Agreement. If the monthly rent installment payment, any previous balance due, and any other outstanding payment, is received and accepted on or before the associated due date and Resident complies with the maintenance requirements contained herein, a ONE HUNDRED AND 00/100 DOLLAR ( $100.00 ) DISCOUNT will be credited to the associated payment. However, any payment not received by Noon 5 calendar days after associated due date is considered delinquent and eviction proceedings begin. Your payment is critical. No excuses for non-payment of any outstanding payment, including but not limited to ill health, accident, loss of job, marriage, divorce, loss of Co-lessee, financial problems, or family emergencies, etc. Failure to pay as provided by this lease will result in immediate termination of this rental agreement and eviction without statutory five-day notice to vacate.
5. ADDITIONAL RENT & RETURNED CHECKS: If Management elects to accept any outstanding payments after their associated due date, resident agrees to pay $20.00 for each day after the associated due date as additional fee. In the event collection of past due payment must be made by the Management at the Property location, the Resident agrees to pay a $100.00 collection fee as additional fee for each such attempted collection. The additional fee shall continue to accrue at the rate of $20.00 per day until all outstanding payments, lost discounts, and any other amounts owing under this Agreement are paid in full. In the event any check given by Resident to Management is returned by the bank unpaid, Resident agrees to pay to Management $75.00 as additional fee, forfeit the outstanding payment discount for that month, and agrees to pay additional fee of $20.00 per day after the associated due date until Resident’s account is brought current. This charge will be waived if the bank verifies, in writing, the check was returned due to their error. Any returned check must be redeemed by cashier’s check, certified check or money order. Deductible
MAINTENANCE, REPAIRS: Resident shall have 30 days after moving in to inform the Management of any repairs needed to any of the systems or appliances that are provided by the Management. Such repairs shall be the responsibility of the Management. After said 30 days, the Resident shall be responsible for any repairs with a total cost of $100.00 or less. For repair items in excess of $100, Resident shall be responsible for a deductible cost of $100 for each repair item. Management shall be responsible for repairs in excess of $100.00 with the exception of such repairs that may be brought about by misuse, neglect, or abuse by Resident, or any other occupant of the property, as well as guests of the Resident. The cost of these repairs shall be the responsibility of the Resident. Resident agrees to report in writing to the Management any and all damages to the leased premises within twenty-four hours of its occurrence, and upon Resident’s failure to do so, Resident shall be responsible for any repair resulting from the Resident’s failure to give proper notice. Should Resident fail or refuse to make minor repairs (those costing less than $100.00), the Management may cause same to be done and the cost thereof shall be additional rent immediately due from Resident to Management. Failure to pay such sums shall be considered a breach of this lease including but not limited to deducting said amount from the Resident’s security deposit.
Appliances:
APPLIANCES: All appliances includes but not limited to refrigerator, range oven, clothes washer, dryer are specially excluded from this agreement. Such appliances, if provided, remain as a convenience to Resident and Management assumes no responsibility for their operation. No part of the monthly rent is attributable to them. Resident shall return any appliance on premises at the signing of this Agreement upon move-out in the same condition as at the signing of this Agreement.
Renters Insurance:
RENTERS INSURANCE: Resident agrees to purchase comprehensive insurance, known as a Renter’s Insurance Policy, before the move-in date against all perils, including but not limited to insurance on personal property or property of other persons from protection of loss due to or caused by theft, vandalism, bursting or breaking pipes, by or from fire, windstorm, hail, flooding, leakage, steam, snow or ice, by or from running water, backing up of drainage pipes, seepage, or the overflow of water or sewage on the Property. Said policy shall include physical injury and liability coverage of $300,000.00 minimum and shall name management as an “Additional Insured” in the policy. Management MUST be provided a copy of Renter’s Insurance Policy naming Management as co-insured. Policy must be paid in full for one full year and such proof of payment provided with copy of policy. Failure to do so may be considered as a default of this Rental Agreement which may result in dispossessory action being taken against Resident if Resident does not cure such default. Failure of Management to obtain its copy does not relieve Resident of their obligation to obtain this insurance policy. Resident shall provide Management proof of auto insurance for any vehicles kept on the property.
Waiver of Notice:
WAIVER OF NOTICE: Upon termination of the right of occupancy for any reason, Resident hereby expressly waives notice to vacate premises prior to institution of eviction proceedings in accordance with Louisiana CCP Article 4701 and Louisiana CC article 2713.
